13.09  USE REGULATIONS:  NEIGHBORHOOD BUSINESS DISTRICT.  No building or premises shall be used and no building shall be erected or altered unless otherwise provided in this chapter, except for one or more of the following uses and provided that no outside storage, equipment testing or repair shall be allowed for any use and all business activity shall be confined to the interior of the building.

 

             (1)  Paint, glass, and wallpaper stores (523).

 

             (2)  Hardware stores (525).

 

             (3)  Grocery stores (541).

 

             (4)  Meat and fish (seafood) markets, exclusively for retail sales of meats butchered by others only (542).

 

             (5)  Fruit and vegetable markets (543).

 

             (6)  Candy, nut, and confectionery stores (544).

 

             (7)  Dairy products stores (545).

 

             (8)  Retail bakeries providing baking on premises shall be permitted only for sale on premises and the number of employees shall be limited to five for each bakery (546).

 

             (9)  Miscellaneous food stores (591).

 

            (10)  Drug stores and proprietary stores (591).

 

            (11)  Sporting goods stores and bicycle shops (5941).

 

            (12)  Book stores (5942).

            (29)  The following health-related services are allowed as individual offices not in a clinic setting or group of two or more practitioners in a single building or site:

(38)    (Cr. GO 13-98)  Water-based recreational facilities subject the conditions of §13.63, Green Bay Municipal Code, are permitted as a conditional use.

 

            13.28  HEIGHT, AREA, AND SETBACK REGULATIONS:  NEIGHBORHOOD BUSINESS DISTRICT.  The height of building, the minimum dimensions of yards and other open spaces surrounding buildings, and the maximum building area of the lot shall be as follows:

 

            (1)  HEIGHT.  No building shall exceed 2 1/2 stories or 35' in height.

 

            (2)  REAR YARD.  There shall be a rear yard of not less than 25' on all interior lots.

 

            (3)  SIDE YARD.  The side yard requirements on a lot adjoining another zoning district shall be not less than the side yard required of such adjoining district.  Side yards, where provided, shall be not less than 6', provided no side yard shall be required where a building adjoins another building within the district and where the exterior architectural treatment of the building is the same as the one adjoining.

 

            (4)  FRONT YARD.  There shall be a front yard not less than that required in an adjoining zone on the same side of the street.

 

            (5)  APPROVAL OF PLANS.  Before a building permit for the erection of any building or structure in the Neighborhood Business District shall be issued, complete site plans, floor plans, and elevations shall be submitted and approved by the Plan Commission.
